Marshal Worker Safety — Terms of Use
1. These terms
These Terms of Use (“Terms”) govern your use of the Marshal Worker Safety app (“Marshal”, “the app”), published by Zetifi Pty Ltd (“Zetifi”, “we”, “us”), ABN 98 621 129 244, C/- Navigate Advisors, 63 Baylis Street, Wagga Wagga NSW 2650, Australia.
By enrolling in or using the app, you agree to these Terms. If you do not agree, do not use the app.
2. Marshal is provided to you by your employer
Marshal is an enterprise app. You are using it because your employer (or the organisation that engaged Zetifi) has provided it to you for workplace safety. You enrol using an invitation from your employer and against your employer’s own Microsoft 365 environment. There is no public or consumer sign-up.
Your use of the app is also subject to your employer’s own policies (for example, their workplace, safety, and acceptable-use policies). The commercial agreement between Zetifi and your employer governs the overall service. If anything in these Terms conflicts with that agreement on a commercial matter, that agreement prevails; these Terms govern your individual use of the app.
3. Licence
Subject to these Terms, Zetifi grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on a device you own or control, for the purpose of workplace safety while you are engaged by the organisation that provided it.
4. Your responsibilities
You agree to:
- use the app only for its intended workplace-safety purpose;
- keep your device and your enrolment reasonably secure;
- not trigger emergency or duress features other than for a genuine situation or an agreed test;
- not interfere with, reverse-engineer, or attempt to disrupt the app or the services behind it, except to the extent the law permits;
- not use the app to break the law or infringe anyone’s rights.
Triggering false emergencies wastes safety resources and may breach your employer’s policies.
5. Permissions and background location
The app asks for permissions (including “Always” location) that some safety features need to work when your phone is locked or the app is closed. You can decline or later change these in your device settings, but some features (for example duress location and check-in follow-up) will not work without them. How your information is handled is described in our Privacy Policy.
6. Safety disclaimer — please read
Marshal is a safety aid. It is not a guarantee of safety, it does not prevent incidents, and it is not a replacement for emergency services. Please read this section carefully, because it describes the limits of what the app can do.
Always call your local emergency number. In a life-threatening emergency, contact your local emergency number (for example 000 in Australia, 111 in New Zealand, 112 in the EU, 911 in North America) by the most reliable means available. Do not rely on the app as your only way of summoning help.
We do not warrant that an alert will be delivered. A duress alert, an emergency, or a check-in signal depends on things outside our control: your device and its battery, your device’s location services, mobile or internet connectivity, third-party networks and carriers, and your employer’s own configuration. Where any of these is unavailable, degraded, misconfigured, or out of coverage, an alert or your location may be delayed, incomplete, or not delivered or acknowledged at all. To the maximum extent permitted by law, Zetifi does not warrant the delivery, receipt, acknowledgement, or timeliness of any alert, emergency, or check-in signal. This is most likely to matter in areas of poor or no coverage.
Marshal is not a monitored emergency service. Zetifi does not operate a monitoring centre or an emergency-response service, and does not watch for or respond to your alerts. When the app sends an alert, it is delivered into your employer’s own systems. Whether anyone sees it, and whether and how they respond, is determined entirely by your employer’s safety procedures and staffing, not by Zetifi.
Location is approximate. Any location shown in or sent by the app is approximate and depends on your device and your surroundings.
You should follow your employer’s safety procedures and use your own judgement. The app supports those procedures; it does not replace them.
7. Availability
We aim to keep the app and the services behind it available, but we do not promise uninterrupted or error-free operation. We may update, suspend, or withdraw features, and we may perform maintenance. Service levels, where they apply, are set out in the agreement between Zetifi and your employer.
8. Intellectual property
The app, its content, and the services behind it are owned by Zetifi or its licensors and are protected by law. These Terms do not transfer any ownership to you. You may not copy, modify, distribute, or create derivative works except as the law allows or we permit in writing.
9. Third-party services
The app works with third-party services, including Microsoft 365 (your employer’s environment), telematics providers your employer uses, error-reporting (Sentry), and, where enabled, messaging carriers for emergency alerts. Those services are governed by their own terms, and we are not responsible for them.
10. Disclaimers and limitation of liability
Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law and equivalent laws elsewhere. Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, that the law says cannot be excluded or limited. The clauses below apply only to the extent the law allows.
To the maximum extent permitted by law:
- the app is provided “as is” and “as available”, and we exclude all implied terms, warranties, and conditions not expressly stated here;
- we are not liable for any indirect, incidental, special, or consequential loss, or for loss arising from circumstances outside our reasonable control (including device or battery failure, loss of connectivity or coverage, third-party network or carrier failure, any failure, delay, or non-acknowledgement in delivering an alert, emergency, or check-in signal as described in section 6, or your employer’s configuration or response decisions);
- where our liability cannot be excluded but can be limited, our total liability to you is limited to resupplying the app or the cost of doing so.
Because your employer controls how Marshal is configured and how alerts are responded to, claims about the safety response itself are a matter between you and your employer.

12. Changes, suspension, and termination
We may update these Terms as the app changes; the current version is always at the URL above, and material changes will be communicated through your employer. Your right to use the app may end when your engagement with the organisation that provided it ends, or if your employer’s agreement with Zetifi ends, or if you breach these Terms.
13. App-store provisions
If you obtained the app from the Apple App Store or Google Play:
- these Terms are between you and Zetifi, not with Apple or Google;
- Apple and Google are not responsible for the app or its support, and have no obligation to provide maintenance or address any claims relating to the app;
- you confirm you are not located in a country subject to a relevant trade embargo and are not on a prohibited-parties list;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to your use of the app obtained from the App Store;
- you must comply with the applicable app-store terms in addition to these Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that place, without limiting any right you have under the law where you live.
